Terms & Conditions – Namma Booking

These Terms and Conditions (“Terms”) govern your access to and use of the Namma Booking platform, including our website (www.nammabooking.com), services, and any bookings made through it. By accessing or using our platform, you agree to be legally bound by these Terms. If you do not agree, you must not use our services.

1. Role of Namma Booking

Namma Booking operates as an online marketplace that connects travellers with independent accommodation providers across India. We are a technology platform — we do not own, manage, or operate any of the properties listed on our site.

  • We act solely as an intermediary between customers and accommodation providers.
  • The accommodation agreement is between you and the provider; Namma Booking is not a party to that agreement.
  • We are not responsible for damages, losses, or injuries arising from your stay or from actions of accommodation providers.
  • By using our platform, you agree to indemnify and hold Namma Booking harmless from claims arising from your use of the platform or your interactions with providers.

2. Booking Process & Confirmation

A booking is not confirmed until (a) the accommodation provider formally accepts it and (b) the required payment is successfully received by us.

  • You are responsible for reviewing the accommodation provider’s specific terms, house rules, and cancellation policy before completing a booking.
  • Room images, descriptions, and amenity lists on our platform are for illustrative purposes. Actual conditions may vary; we recommend confirming details with the provider.
  • Namma Booking facilitates payments on behalf of providers but is not liable for delays caused by banks or payment gateways.

Property Name Notice

To protect the privacy of our accommodation partners and prevent unsolicited direct contact, certain properties may be displayed under an alternative marketing name on our platform. By making a booking, you acknowledge and agree that the property name shown prior to booking may differ from the official property name. The confirmed booking details, including the official property name and full address, will be provided after booking confirmation. This naming practice does not affect the location, quality, amenities, or features of the accommodation.

3. Customer Responsibilities

By making a booking on Namma Booking, you agree to the following responsibilities:

  • Provide accurate and up-to-date personal, payment, and contact information at the time of booking.
  • Comply with the accommodation provider’s check-in/check-out times, house rules, and applicable local regulations.
  • Pay all fees, applicable taxes, and charges associated with your booking promptly.
  • Raise any special requests, on-site complaints, or issues directly with the accommodation provider.
  • Refrain from any fraudulent, abusive, or unlawful use of the Namma Booking platform.
  • Take reasonable care of the property during your stay and be liable for any damage caused.
  • Ensure your own safety, security, and wellbeing during travel. Namma Booking is not responsible for personal safety incidents at properties.

4. Accommodation Provider Responsibilities

All accommodation providers listed on Namma Booking are required to:

  • Maintain accurate, current, and truthful information about their property, pricing, availability, and amenities on our platform.
  • Keep the property clean, safe, and in good working condition.
  • Comply with all applicable laws, safety regulations, and licensing requirements.
  • Honour all confirmed bookings and deliver the services described at the time of booking.
  • Handle complaints, disputes, and service issues directly with guests during their stay.
  • Manage cancellations and modifications in accordance with their stated policies.

Namma Booking reserves the right to remove any provider found in breach of these obligations.

5. Cancellations & Refunds

Cancellation and refund terms are set by the individual accommodation provider and are clearly displayed on the property listing page before you book. It is your responsibility to review these before completing your booking.

  • Cancellations must be submitted through the Namma Booking platform or by contacting our support team.
  • Refund eligibility depends on the provider’s specific cancellation policy (e.g., free cancellation, partial refund, or non-refundable).
  • Where a refund is approved, processing times may vary between 5–10 business days depending on your bank or payment method. Namma Booking is not liable for delays caused by payment processors or banks.
  • In cases of Force Majeure (natural disasters, government-mandated shutdowns, etc.), Namma Booking will work with both the customer and provider to find a fair resolution, which may include vouchers or rescheduling options.
  • Namma Booking’s liability in any refund scenario is limited to the amount you paid for the booking in question.

6. Privacy & Data Use

Namma Booking is committed to protecting your personal information. Our full Privacy Policy explains in detail how we collect, store, use, and share your data.

  • By using our platform, you consent to the collection and use of your data as described in our Privacy Policy.
  • We use cookies and similar tracking technologies to improve user experience. You can adjust cookie preferences via your browser settings or our cookie consent banner.
  • We do not sell your personal data to third parties. We may share data with accommodation providers solely to fulfil your booking.
  • We may display relevant, targeted advertisements on our platform; we are not responsible for the content or accuracy of third-party advertisements.
  • All data handling is conducted in compliance with the Information Technology Act, 2000 and applicable Indian data protection laws.

7. Liability & Indemnity

To the maximum extent permitted by applicable law:

  • Namma Booking is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform or a booked property.
  • Our total liability to you in any matter related to a booking is limited to the amount you paid for that specific booking.
  • We are not liable for non-performance or service failures caused by Force Majeure events including but not limited to natural disasters, floods, earthquakes, pandemics, strikes, or government actions.
  • You agree to indemnify, defend, and hold harmless Namma Booking and its affiliates, directors, employees, and agents from any claims, losses, or expenses arising from your use of the platform or any breach of these Terms.

8. Dispute Resolution

We encourage all parties to resolve disputes amicably and in good faith. The following process applies:

  • Step 1 — Direct Resolution: Contact the accommodation provider directly to resolve any complaint arising during or after your stay.
  • Step 2 — Namma Booking Support: If resolution with the provider is not possible, contact us at enquiry@nammabooking.com. We will make reasonable efforts to assist.
  • Step 3 — Mediation: Namma Booking may facilitate mediation between parties. The costs of mediation will be shared equally unless otherwise agreed upon in writing.
  • Step 4 — Arbitration/Courts: Unresolved disputes will be subject to the exclusive jurisdiction of courts in Karnataka, India.

Namma Booking is not responsible for the outcome of any dispute between a customer and an accommodation provider.

9. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India, with specific reference to the laws of the State of Karnataka.

Any dispute, claim, or controversy arising out of or relating to these Terms, including their validity, interpretation, or enforceability, shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.

10. User-Generated Content

Customers may submit reviews, ratings, photos, or comments (“Content”) regarding their stay through the Namma Booking platform.

  • By submitting Content, you grant Namma Booking a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, display, and distribute that Content on our platform and marketing materials.
  • You confirm that your Content is accurate, honest, lawful, non-defamatory, and does not infringe any third-party rights.
  • Namma Booking reserves the right to remove, edit, or decline to publish any Content that violates these Terms, is false, misleading, offensive, or otherwise inappropriate.
  • You remain solely responsible for any Content you submit.

11. Termination

Namma Booking reserves the right to suspend, restrict, or permanently terminate your access to the platform at any time, without prior notice, if:

  • You breach any provision of these Terms and Conditions.
  • You engage in fraudulent, abusive, or unlawful conduct on or via the platform.
  • Your account is found to be involved in misuse, chargebacks, or harmful activity.

Upon termination, provisions relating to intellectual property, liability, indemnity, and dispute resolution shall continue to apply.

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Namma Booking has designated a Grievance Officer to address customer complaints.

If you have a complaint regarding your booking or your experience on our platform, please write to the Grievance Officer with your booking reference number, a description of the issue, and any supporting evidence.

13. Miscellaneous

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Namma Booking has designated a Grievance Officer to address customer complaints.

  • Entire Agreement: These Terms constitute the entire agreement between you and Namma Booking with respect to the use of our platform and supersede all prior agreements or understandings.
  • Amendments: Namma Booking reserves the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Failure by Namma Booking to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Third-Party Links: Our platform may contain links to third-party websites. Namma Booking is not responsible for the content, privacy practices, or accuracy of such external sites.
  • Notices: All formal notices to Namma Booking must be sent via email to enquiry@nammabooking.com or in writing to our registered office address.
